General conditions of use of the site and services offered

Use of the site implies full and complete acceptance of the general conditions of use described below. These conditions of use may be unilaterally modified or completed at any time by the company Expat Student and users of the site are therefore invited to consult them on a regular basis. The new clauses will govern for the future all the relations between the parties, and only the new version will be valid between them.

Definitions

User: any natural or legal person who connects to the site

Contents: All the elements constituting the information on the site, in particular texts – images – videos.

Intellectual Property

All data of any nature whatsoever, and in particular the texts, graphics, logos, icons, images, videos, brands, software, site characteristics appearing on the Site are necessarily protected by copyright, trademark law and all other intellectual property rights, and belong to the company or to third parties who have authorised the company to use them.

Any reproduction, representation, modification, publication, adaptation of all or part of the elements of the site, regardless of the means or process used, is prohibited without the prior written authorisation of the company.

Any unauthorised use of the site or of any of the elements it contains will be considered as an infringement and will be prosecuted in accordance with the provisions of articles L.335-2 and following of the Intellectual Property Code.

Access to the Site

Access to the Site is free, and provided on a continuous and permanent basis, except in cases of force majeure or events beyond the Company’s control, and subject to any breakdowns and technical interventions, maintenance and updating necessary for the proper functioning of the Site.

The Site and the host cannot be held liable in the event of malfunction of the Internet network, telephone lines or computer and telephone equipment related in particular to network congestion preventing access to the server.

Any creation of a hypertext link from an Internet site to the Site must be subject to the Company’s express prior authorisation, which may be withdrawn at any time by the Company, without having to justify its decision to do so.

Responsibility

The purpose of the site is to provide information concerning all of the company’s activities. 

The company endeavours to provide reliable and qualitative information on the site, but this information is given for information purposes only. The company cannot be held responsible for omissions, inaccuracies and shortcomings in updating, whether caused by the company or by third party partners who provide it with this information. The company does not guarantee the accuracy, timeliness and completeness of the information disseminated on the site, nor the compliance of the said information with the use that Users wish to make of it.

Consequently, Users acknowledge that they use this information under their exclusive responsibility.

The company cannot therefore be held liable for any direct or indirect damage suffered by Users or by third parties who may find their source in the information disseminated on the Site, and more generally, in the consultation and use of the Site.

Furthermore, the company does not monitor other sites linked to the Site by means of hypertext links, and declines all responsibility for these sites and their content.

The Company shall not be held liable for direct or indirect damage caused to the user’s equipment, when accessing the site, and resulting either from the use of equipment that does not meet the necessary specifications, or from the occurrence of a bug or incompatibility.

In the event that interactive spaces are set up on the site (possibility of asking questions in the contact space), the company reserves the right to delete, without prior notice, any content deposited in this space that contravenes the legislation applicable in France, in particular the provisions relating to data protection. Where appropriate, the company also reserves the right to challenge the user’s civil and/or criminal liability, in particular in the event of a message of a racist, insulting, defamatory or pornographic nature, regardless of the medium used (text, photograph, etc.).

Applicable law and jurisdiction

Any dispute in connection with the use of the site is subject to Austrian law.

Any dispute arising from the execution or interpretation of these general conditions obliges the parties to come together and try to find an amicable solution to their dispute, before referring the matter to the competent jurisdiction. In the absence of an amicable agreement, exclusive jurisdiction is given to the competent courts of Vienna.
